PIEMAN’S & FRESHSTOP CONSUMER CONSUMPTION DRIVE (the “Competition”)
TERMS AND CONDITIONS
The promoter is RCL FOODS Consumer (Pty) Limited and Paton Tupper (Pty) Ltd (“the Promoter”).
Any persons entering or participating in this Competition (the “Participant”) accept and agree that by entering this Competition they have had an opportunity to read and consider these Terms and Conditions and that they are bound by these Terms and Conditions.
- What is the Prize
1.1 A Participant stands a chance of winning a share of R250 000.00 (two hundred and fifty thousand rand) in cash payouts and MASTERCARD vouchers (the “Prize”). The Prize is broken down as per below for the total Competition period:
1.1.1 R100.00 (one hundred rand) cash payouts X 1500 (R150 000.00 in total); and
1.1.2 R500.00 (five hundred rand) MASTERCARD vouchers X 200 (R100 000.00 in total).
1.2 To redeem:
1.2.1 R100 cash payouts – Winners will receive a PIN to withdraw the cash from any ABSA ATM
1.2.2 R500 MASTERCARD vouchers – Winners will receive their Mastercard to their specified delivery address. Once the proof of delivery has been received, the MASTERCARD will be activated with the R500 – the MASTERCARD is redeemable at all FRESHSTOP stores nationwide. No substitute the Prize/s with any other Prize of comparable commercial value.
- Who may Participate
2.1 Any legal resident of South Africa who is 18 (eighteen) years or older may participate in the Competition.
2.2 No director, employee, agent or consultant of:
2.2.1 the Promoter;
2.2.2 any other subsidiary or associated person who controls or is controlled by the Promoter;
2.2.3 the supplier of goods or services in connection with the Competition; or
2.2.4 the marketer of the Competition, or their spouses, life partners, business partners or immediate family members, may enter this Competition.
- How to Participate
3.1 To enter this Competition,
3.1.1 Participants must purchase any 2 (two) PIEMAN’S pies from any CALTEX FRESHSTOP store nationwide during the Competition period;
3.1.2 Take a clear photo of their till slip showing the above purchase;
3.1.3 WhatsApp their till slip photo with the title ‘FRESHSTOP’ to 087 240 6374; and
3.1.4 Follow the prompts to find out if they are a Winner. Standard data rates apply.
3.2 Participants may enter as many times as they wish provided a new till slip is attached to the WhatsApp message each time. Duplicate till slips will automatically be rejected.
3.3 Once a WhatsApp number has been selected as a Winner that number will no longer be able to participate in the Competition for the remainder of the Competition period.
3.4 Entries which are unclear, illegible or contain errors will be declared invalid.
- Prize Allocation Mechanics
4.1 The Promoter’s outsourced Mobile Marketing Agency, Swiffy (Pty) Limited, will receive, process and manage all entries and is responsible for notifying the Winners and allocating the Prizes.
4.2 The Mobile Marketing Agency’s team receives the WhatsApp entry and immediately sends a response message to say the entry has been received and will be verified and validated against the photo of the till slip.
4.3 Once the photo of the till slip has been validated, the Participant will receive a WhatsApp message to say they have been entered into the draw. The till slip photo provides proof of purchase should the Participant be drawn as a Winner. Participants must therefore keep their till slips to produce in the case that they are selected as a Winner.
4.4 The Promoter shall not be responsible for any lost, damaged or delayed entries for any reason whatsoever, and proof of sending will not be accepted as proof of receipt by the Promoter. The Promoter is not liable for any technical failures affecting the participation and/or Prize redemption process of the Competition.
4.5 In the event that entry into this Competition is contingent on the Participant entering any website or social media page or application, the Participant hereby acknowledges that any and all costs associated with the required internet connection will not constitute a cost of entering into this Competition and shall be borne solely by the Participant.
- Personal Information
5.1 By entering this Competition the Participant consents to the collection, processing and further processing of his/her personal information (including personal information contained in electronic communications) by the Promoter for the purposes of conducting this Competition and facilitating the Participant’s participation in the Competition.
5.2 By posting any content, images, or comments on any of the Promoter’s public and/or social media platform, a Participant consents to and gives the Promoter a world-wide royalty free licence to reproduce, modify, adapt and publish such content, images or comments for the purposes of promoting the Promoter’s products and/or services.
- Indemnity
By entering the Competition, the Participant unconditionally and irrevocably indemnifies and holds harmless the Promoter, as well as its holding company, its subsidiaries and any subsidiaries of its holding company, and their successors and assigns, directors, employees, agents or consultants against all and any losses, claims, proceeding, actions, damages, (direct, consequential or otherwise) liability, demands, expenses, legal costs (on an attorney and own client basis) howsoever arising out of, based upon, or in connection with (directly or indirectly) the Participant’s participation in the Competition and the Prize/s.
- Duration
7.1 This Competition runs from 1st November 2020 and closes at midnight South African time on
31st December 2020 (the “Closing Date”). Any entries received after the Closing Date will not be considered.
7.2 The Promoter reserves the right to reasonably extend, shorten, suspend the time period of the Competition or terminate the Competition for technical, commercial, and/or operational reasons, or for reasons beyond its control. The Competition, Prize and Terms and Conditions may be reasonably amended by the Promoter, at any time during the Competition. In such event, all Participants waive any rights that they may have/purport to have in terms of this Competition, and acknowledge that they shall have no recourse against the Promoter whatsoever.
7.3 Winners will be selected daily using an electronic random picker. Once a WhatsApp number has been selected as a Winner that number will no longer be able to participate in the Competition for the remainder of the Competition period. As such, Participants are only eligible to win once during the Competition period.
7.4 There will be an overall Competition total of 1700 (one thousand seven hundred) Winners.
7.5 The judges’ decision, if applicable under clause 7.3 above, will be final and binding and no correspondence will be entered into.
7.6 The Participants selected as the recipients of the Prizes (the “Winner”) will be notified via the WhatsApp number they used to enter the Competition within 1 (one) hour of entry. In the event that a Winner cannot be successfully contacted, or fails to respond to the Promoter within 72 hours (3 days) of receiving the WhatsApp notification, the Promoter reserves the right to select another Winner in substitution.
7.7 The Promoter may require the Winners to:
7.7.1 provide their name, identity number, and till slip used to enter the Competition to enable the Promoter to verify the entry;
7.7.2 sign an acknowledgment of receipt of the Prize, and indemnity; and
7.7.3 where the entry includes the submission of any work eligible for copyright in terms of the Copyright Act No. 98 of 1978, conclude an agreement of assignment whereby any rights that a Winner may have in respect of such works are transferred to the Promoter.
7.8 Should a Winner refuse to comply with the rules set out in 7.7 above for any reason, then the Winner shall be deemed to have rejected the Prize, and it shall revert back to the Promoter.
7.9 Any Winner may be requested to attend the draw and announcement of the Winners, to take part in the Promoter’s publicity campaigns or to allow their names and likenesses to be used by the Promoter for promotional purposes. A Winner, however, is entitled to decline such a request.
7.10 Where a Winner consents to take part in the Promoter’s publicity campaigns, they will not be entitled to any remuneration for such participation and all materials arising from such participation will be the sole property of the Promoter.
- Disputes
8.1 Should any dispute arise in relation to these Terms and Conditions, the Promoter’s decision shall be final and no correspondence shall be entered into.
